The following dismissals were recently handed out in Kenai District Court:

A charge of driving while license canceled, revoked or suspended against Tyler Joseph Fuxa, 28, of Soldotna, was dismissed. Date of the charge was Nov. 29.

Charges of one count of driving while license canceled, revoked or suspended and one count of no motor vehicle liability insurance against Tyler Fuxa, 28, of Soldotna, were dismissed. Date of the charges was Dec. 7.

A charge of driving while license canceled, revoked or suspended against Tyler Joseph Fuxa, 28, of Soldotna, was dismissed. Date of the charge was Dec. 16.

Charges of one count of driving while license canceled, revoked for suspended and one count of no motor vehicle liability insurance against Tyler Joseph Fuxa, 28, of Soldotna, were dismissed. Date of the charges was Dec. 18.

Charges of one count of driving while license canceled, revoked or suspended and one count of violating conditions of release for a misdemeanor against Tyler Joseph Fuxa, 28, of Soldotna, were dismissed. Date of the charges was Dec. 30.

Charges of one count of driving while license canceled, revoked or suspended and one count of no motor vehicle liability insurance against Tyler Joseph Fuxa, 28, of Soldotna, were dismissed. Date of the charges was Feb. 4.

The following judgments were recently handed down in Kenai District Court:

Tristan Aaron Russell Boot, 23, of Kenai, pleaded guilty to driving in violation of instruction permit, committed Feb. 26. He was fined $200 and a $100 court surcharge.

Joseph Chikoyak, Jr., 46, of Kenai, pleaded guilty to an amended charge of second-degree harassment (likely to provoke violence), committed Oct. 13. He was sentenced to 90 days in jail (time served) and fined a $100 court surcharge and a $50 jail surcharge.

Joseph Chikoyak, 46, of Kenai, pleaded guilty to second-degree criminal trespass (upon premises), committed Mar. 9. He was sentenced to 30 days in jail and fined a $100 court surcharge and a $50 jail surcharge.

Joseph Chikoyak, Jr., 46, of Kenai, pleaded guilty to violating conditions of release for a misdemeanor, committed Mar. 9. He was sentenced to 30 days in jail and fined a $100 court surcharge and a $50 jail surcharge.

Ronald Micheal Finch, 43, of Anchorage, pleaded guilty to driving while license canceled, revoked or suspended with a previous conviction, committed Feb. 5. He was fined a $100 court surcharge and placed on probation for 24 months.

Tyler Joseph Fuxa, 28, of Soldotna, pleaded guilty to driving while license canceled, revoked or suspended for a criminal offense, committed Mar. 4. He was sentenced to 180 days in jail with 170 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, and placed on probation for 24 months. All other charges in this case were dismissed.

Rory J. Hoeldt, 46, of Nikiski, pleaded guilty to amended charges of two counts of fifth-degree misconduct involving a controlled substance, committed Apr. 7, 2020. On count one, he was fined $250, a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, forfeited items seized, and was placed on probation for 36 months. On count two, he was fined $250, ordered to comply with all the conditions imposed in count one, and was placed on probation for 36 months. All other charges in this case were dismissed.

Laife Inkster, 34, of Kenai, pleaded guilty to driving while license canceled, revoked for suspended with a previous conviction, committed Feb. 19. He was sentenced to 10 days in jail and fined a $100 court surcharge and a $50 jail surcharge.

Amanda Marie Kivi, 32, of Nikiski, pleaded guilty to one count of fifth-degree misconduct involving a controlled substance, committed June 18, and one count of violating conditions of release for a misdemeanor, committed July 17. She was sentenced to 120 days in jail with all but time served suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with a specifically named person, ordered not to possess or consume any controlled substances without a prescription, taken only as prescribed, and maintained is original container, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, and was placed on probation for two years. All other charges in this case were dismissed.

Gavin Christopher Medcalf-Jackson, 21, of Soldotna, pleaded guilty to disorderly conduct (challenge to fight), committed Feb. 14. He was fined $500 and a $100 court surcharge and may perform 50 hours of community work service in lieu of the $500 fine.

Melody Ann Miller, 34, of Anchorage, pleaded guilty to concealment of merchandise (under $250), committed Feb. 25, 2019. She was fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with Save-U-More store, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, and was placed on probation for 12 months.

Melody A. Miller, 34, of Anchorage, pleaded guilty to violating condition of release for a felony, committed Sept. 3, 2019. She was fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, forfeited all items seized, and was placed on probation for 12 months.

Melody A. Miller, 34, of Kenai, pleaded guilty to fifth-degree misconduct involving a controlled substance, committed Dec. 28, 2019. She was fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, forfeited all items seized, and was placed on probation for 24 months. All other charges in this case were dismissed.

Harley E. Rice, 40, of Soldotna, pleaded guilty to violating conditions of release for a misdemeanor, committed Jan. 27, 2020. He was fined a $100 court surcharge and a $50 jail surcharge and ordered to have no contact with a specifically noted address. All other charges in this case were dismissed.

Harley Eugene Rice, 40, of Soldotna, pleaded guilty to one count of driving under the influence, one count of fifth-degree misconduct involving a controlled substance, and one count of violating conditions of release for a misdemeanor, committed June 24, 2020. On count one, he was sentenced to 90 days in jail with 87 days suspended, fined $2,000 with $500 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $330 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had his license revoked for 90 days, ordered not to possess controlled substances without a valid prescription, taken as prescribed and maintained in original containers, and was placed on probation for 12 months. On count two, imposition of sentence was suspended, and he was placed on probation for 12 months, ordered not to possess controlled substances without a valid prescription, taken as prescribed, and maintained in original containers, and ordered to complete a substance abuse assessment and follow all recommendation. He will have to serve 30 days in jail if he doesn’t comply. All other charges in this case were dismissed.

Johnny E. Riddle, 71, of Soldotna, pleaded guilty to second-degree criminal trespass (upon premises), committed Feb. 3. He was fined a $100 court surcharge and a $50 jail surcharge, ordered to have no contact with Tesoro 2 Go #207, and placed on probation for 12 months.

Brandon Saltenberger, 20, of Kenai, pleaded guilty to third-degree theft, committed Oct. 26. He was sentenced to 300 days in jail with all but time served suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with a specifically named person, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, forfeited all items seized, and was placed on probation for three years. All other charges in this case were dismissed.

Dustin Lee Sena, 36, of Soldotna, pleaded guilty to an amended charge of disorderly conduct (creating a hazardous condition), committed Jan. 1. He was sentenced to three days in jail with all but time served suspended, fined $1,000 with $750 suspended, a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to complete anger management and follow all recommendations, may apply the cost of anger management toward the fine, may have contact with the victim at the victim’s request, and was placed on probation for 12 months. All other charges in this case were dismissed.

Darren Allen Shay, 55, of Kenai, pleaded guilty to driving while license canceled, revoked or suspended for a criminal offense, committed Oct. 28. He was fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, had his license suspended for 30 days, and was placed on probation for 12 months.

Preston J. Williams, 23, of Kenai, pleaded guilty to driving under the influence, committed Dec. 13. He was sentenced to 150 days in jail with 130 days suspended (time served), fined $4,000 with $1,000 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $1,467 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had his license revoked for one year, ordered ignition interlock for 12 months, ordered not to possess, consume or buy alcohol for three years, and was placed on probation for three years.

Preston James Williams, 23, of Kenai, pleaded guilty to one count of driving under the influence and one count of violating conditions of release for a misdemeanor, committed Dec. 26. On the count of driving under the influence, he was sentenced to 150 days in jail with 130 days suspended, fined $4,000 with $1,000 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $1,467 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had his license revoked for one year, ordered ignition interlock for 12 months, ordered not to possess, consume or buy alcohol for three years, and placed on probation for three years. On the count of violating conditions of release, he was placed on probation for 36 months. All other charges in this case were dismissed.

The following judgments were recently handed down in Kenai Superior Court:

Gary John Horwath, 70, address unknown, pleaded guilty to one count of first-degree indecent exposure (victim under age 16), committed Oct. 7, 2016. He was sentenced to four years in prison with two years suspended, credited for time already served and for time served on electronic monitoring, fined a $100 court surcharge and a $200 jail surcharge with $100 suspended, ordered to have no contact with victims until unconditional discharge, forfeited all items seized, ordered, among other conditions of probation, to register as a sex offender, to obtain a sex offender evaluation/risk assessment to determine the need for sex offender monitoring/counseling/treatment and follow all recommendations, ordered not to enter any establishment whose primary business is the sale of sexually explicit material or enter any establishment where nude dancing or posing is part of the entertainment, including but not limited to strip clubs, massage parlors, adult bookstores, adult video stores, phone services and internet sites, ordered to not knowingly have any contact with a person under 18 years of age unless in the immediate presence of another adult who knows the circumstances of his crime and who is approved in writing by a probation officer, ordered not to enter places where children congregate such as parks, playgrounds and schools and not to live in areas adjacent to schools or places frequented by children without permission of the probation officer, ordered not to reside where a minor under the age of 18 is residing or staying without written permission of the probation officer, the sex offender treatment provider, and the parent/guardian of the minor, and was placed on probation for three years after serving any term of incarceration imposed. All other charges in this case were dismissed.

Willow Rae Napolitano, 23, address unknown, pleaded guilty to one count of fourth-degree misconduct involving a controlled substance, committed June 3, 2020. Imposition of sentence was suspended and she was placed on probation for 36 months, fined a $200 court surcharge and a $200 jail surcharge with $100 suspended, forfeited all items seized, ordered to perform 80 hours of community work service, and ordered, among other conditions of probation, not to use, possess, handle, purchase, give or administer any controlled substances, including marijuana, without a valid prescription (a medical marijuana card does not constitute a valid prescription), ordered not to associate with people who use or sell illegal controlled substances nor enter or remain in places where illegal controlled substances are used, manufactured, grown or sold, and ordered to complete a drug/alcohol assessment and follow all recommendations. All other charges in this case were dismissed.

Leslie Morgan Sanford, 35, address unknown, pleaded guilty to second-degree burglary, committed July 21, 2018. Imposition of sentence was suspended and he was placed on probation for two years, ordered to pay restitution, fined a $100 court surcharge and a $200 jail surcharge with $100 suspended, ordered to pay $250 cost of appointed counsel, ordered to have no contact with Walmart, Soldotna Safeway, two specifically named people or a specifically noted Soldotna address, forfeited all item seized, and ordered, among other conditions of probation, not to use or possess any alcohol or illegal controlled substances, including synthetic drugs and marijuana, ordered to complete a substance abuse assessment and comply with treatment recommendations, and ordered not to associate with individuals who use or sell illegal controlled substances nor remain in places where illegal controlled substances are used, manufactured, grown or sold. All other charges in this case were dismissed.
